The Director of the district office that serves the area where the applicant lives will review the petition to determine whether an interview is required. The director will look at the notes from the initial interview and the quality of the documents submitted with the Form I-751 application. If the director is satisfied based on the written petition that the applicant’s marriage was not entered into in order to obtain immigration benefits, he or she may waive the interview requirement and approve the petition. Otherwise, the applicant and his or her spouse will be scheduled for an interview. If there has been severe abuse and the spouse will not be attending then this adds an additional layer of complication in the process.
